Client Service Agreement for Sauna Membership

This document sets out the Terms and Conditions you need to be aware of when purchasing my Sauna membership. Please take a moment to read it carefully as it sets out your important rights and obligations and I care about making sure we both know where we stand. When you use my services you agree that you are over the age of 18 and willing to be bound by these Terms and Conditions. If you don’t accept this agreement, you should notify me immediately so we can discuss your concerns. 

My services are offered in compliance with Australian Consumer Law.

My Responsibilities

I will tailor your sauna visit to your conditions and goals with herbal tea, chromotherapy and halotherapy. I will clean the sauna after each session and then heat the sauna to kill 99% of bacteria, creating an inherently sterile environment 

Your Responsibilities

It is your responsibility to seek independent advice from your doctor before using my service. You must complete the Infrared Sauna Use Waiver and Release of Liability as honestly as possible. I cannot be held responsible for the results incurred from information you have neglected to tell me. You must inform me immediately of any side effects or problems that arise during or after your sauna, so that I may help you as quickly as possible. 

 

Payment Terms

 

  • Sauna membership will be set us as a WEEKLY DIRECT DEBIT as weekly payments of $50
  • Payments will be debited using a Credit/Debit card only
  • Memberships are week-to-week with NO lock in periods or cancellation fees
  • Maximum of 2 sessions per week. Unused sessions do NOT roll over each week.
  • Each session is limited to 40 mins
  • Maximum of 1 session per day
  • Sessions are for 1 person. Bring a friend is an additional $20 per session, payable when you visit
  • BYO towels, towel hire is $5 
  • Membership is not transferable to another person
  • Membership may be cancelled at any time with 2 weeks notice
  • All prices are in AUD. 
Missed Sessions

My goal at Jervis Bay Naturopathy is to provide quality health care in a timely manner. Therefore, you must notify me if you are unable to attend your appointment no less than 24 hours prior to your scheduled appointment. To assist with this, you will be sent a reminder of your upcoming appointment 48hrs prior to your allocated time. 2 “no show” appointments will result in your membership being terminated

 

Refund Policy

If you change your mind, I offer a full 100% refund up until your first sauna session. 

 

 

Consumer Guarantees

If I need to reschedule your appointment due to unforeseen circumstances, I will reschedule to a time that suits us both. 

 

Results

Results from regular sauna sessions will vary from person to person. No guarantee can be made as to weight loss numbers or health changes. I do not claim to cure any cause, condition or disease. 

I comply with Australian Consumer Law. If you believe there is a major problem, please contact me to discuss the situation so we can work out a win/win solution. 

 

Limitation of Liability

You agree to indemnify me (hold me blameless) for any injury or illness that you might suffer or any damage or loss that might occur while we are working together. If you have any doubts at all about any issue that might arise, you agree that you will conduct your own research and make your own fully informed decision about what is best for you.

In no event shall I or Jervis Bay Naturopathy be liable to you for costs, loss or damage of any kind arising out of or related to this Agreement or the services provided in relation to it. If this clause is unenforceable for any reason, my total cumulative liability for all causes of action of any kind shall not exceed the total amount you have paid me for my services.

Jurisdiction & Dispute Resolution

Jervis Bay Naturopathy in located in NSW. This agreement is subject to the governing law of NSW

If you have any issue or complaint arising out of your use of the packages provided or of this client agreement, I agree to make a genuine effort to resolve the dispute through negotiation and discussion.

If we are unable to resolve a dispute by negotiation and discussion within 14 days, the parties must proceed to mediation with the assistance of an accredited mediator who is independent of the parties. The mediator is to be appointed by agreement of the parties or, failing agreement within twenty-one (21) days of the first notification of the dispute, by a person appointed by the Chair of Resolution Institute, (ACN 008 651 232, Level 2, 13-15 Bridge Street, Sydney NSW 2000; telephone: 02 9251 3366, email: infoaus@resolution.institute) or the Chair’s designated representative. The Resolution Institute Mediation Rules shall apply to the mediation. We agree to share the costs of mediation equally between us.

It is a condition precedent to the right of either party to commence litigation other than for interlocutory relief that it has first offered to submit the dispute to mediation. Litigation is to be considered a last resort and may not be commenced until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.
